I couldn't find any evidence of shirt sale, other than the allegations in the letter. If he WAS selling shirts with the FedEx logo, he would probably be in trouble. Of course, this is based on my vast expert knowledge gained from reading chapter 1 of my IP casebook and only covers trademark thus far; it will be a few weeks until I get to copyright. I'm guessing, though, that the Center has the stronger argument with respect to copyright.
