Ficticious business statement

Does anyone know how long it takes to receive one of these once you apply for them? I'm trying to open a new business account and can't do it without one. Any info would be appreciated.

I tried to open a new bank account this morning for my business. After the falling out with my former partner, he closed the bank account and I need to be able to deposit the checks that come in. I went to the bank this morning and they told me that to open a new business account, I need to file a ficticious business statement with the county clerk. I found the forms to do it online but I don't know if I am looking at days, weeks, or months before they return the paperwork that I need.

I'm just slightly less confused than you are.

I think CP's wondering what a "fictitious business name" is. Basically, if you name your business something that doesn't include your own real name, you have to register the name to be able to do business under it.

The last time I did a Fictitious Name Statement it had to be published over three weeks. Go to your small newspaper and have them do the whole thing. They will do the filing for you too. Sorry but it takes time. Your ex-partner may fight you over the name.

Once you file the ficticious business name with the County clerk, they will give you several of the copies of the filing with their stamp on it...one of them is for the newspaper that you publish the name in, the other copy is for your financial institutions...now if I am remembering correctly, you get all those copies the same day that you file the name with the county clerk, so you could conceivably open the account the same day you file the paperwork with the county clerk. Just don't forget to handle the paper stuff too, as the paper will send you and usually the county clerk proof that it was published. I may be mistaken, but in any case, get down to the county clerks office and handle this asap. It's really a quick process, should only take a few minutes of your time.

hrmm, a thought that occured to me though, is that since you were already doing business under the ficticious name, the county clerk probably already has the name in their files, so what you may nee to do is disolve the partnership in the records, and just get proof from the county clerk that the ficticious name is yours....now the legal and procedural process of doing this is beyond my knowledge, it may be something to look into to make sure all your t's are crossed and i's are dotted. It may be as simple as filling out a disolution of partnership paperword thingy.(I have absolutely no experience with this stuff) and it may require a statement from your former partner....I am not sure......Check with your county clerk, etc.
