I went to the awards blog Tom follows for more info, but what I found was more entertaining.

Any fool who takes the time to do their research could have told the Academy that “Falling Slowly” was NOT written for the film ONCE. It was written in 2006 and released on Glen Hansard and Marketa Irglova’s album “The Swell Season” released on August 6, 2006, before they even started filming the movie. There is no way that the Academy could or should consider this a nominees since it is neither “original” nor written for the film.
