He says as a state agency the foundation must follow Idaho law.

Perhaps Mark is actually trying to do them a favour. By doing this, the case gets media attention and the stupidity of the whole "you're not a family" thing gets in peoples mind. It could help folks reasses their opinion on family... maybe?
